1. Definitions and Acceptance of Terms

1.1 Definitions

  • Bajhi (the “Platform”, “we”, “us”, “our”): Refers to Bajhi.com, a website and service provider operating a marketplace, website builder, hosting, digital goods, automation platform, and freelance services.
  • User (“you”, “your”): Any person or entity creating an account, browsing, interacting with, or otherwise using any feature, service, or tool on Bajhi.
    • Client / Buyer / Purchaser: Any User seeking to commission or purchase digital products, website templates, services, apps, or AI agents on Bajhi.
    • Freelancer / Vendor / Seller / Partner / Shop Owner / Developer: Any User or entity offering products, templates, apps, AI agents, or services for sale on Bajhi. This includes those who create and list website templates, plugins, automations, or provide freelance services.
    • Affiliate: Any User participating in our affiliate marketing program.
    • Content: Any data, files, code, website templates, text, images, videos, applications, documentation, reviews, comments, or other materials uploaded, posted, transmitted, or otherwise made available on or through Bajhi by any User.
    • Account: A registered identity created by a User for accessing platform features.
    • Services: Encompasses all features of Bajhi, including website builder, marketplace, e-commerce, hosting, apps, automations, communication, and related offerings.
  • Agreement: Collectively refers to these Terms and all referenced policies (e.g. Privacy Policy, Refund Policy, etc.).

1.2 Acceptance of Terms

By accessing, browsing, signing up, registering for an account, purchasing, selling, or otherwise using any part of Bajhi and its Services, you agree that you have read, understood, and accepted to be legally bound by these Terms and all related policies.

If you do not agree to these Terms, you may not access or use Bajhi.

  • Binding Agreement: These Terms form a legally binding agreement between you and Bajhi. If you are accessing the Platform on behalf of an organization, you represent you have authority to bind that organization.
  • Updates: We reserve the right to change these Terms at any time, in our sole discretion. We will notify you of changes (e.g. via email, dashboard notice, or the Platform). Continued use after publication of revised Terms constitutes your acceptance.
  • Supplemental Terms: Additional terms may apply to certain products or features (such as subscription levels, freelance projects, API use, etc.), and are incorporated herein by reference.

2. Account Registration and Eligibility

2.1 Who May Register

  • Age Requirement: You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account on Bajhi. If you are under the age of majority, you may only use Bajhi with the consent, supervision, and accountability of a parent or legal guardian, who agrees to be bound by these Terms.
  • Legal Status: By registering, you confirm that you are permitted by the laws of your jurisdiction to access our services, and that Bajhi is not liable for users who access the Platform contrary to their local laws.
  • U.S. Sanctions Compliance: You may not use Bajhi if you are located in a country embargoed by the United States, or are on any U.S. Government list of prohibited or restricted parties.

2.2 User Identity and Information

  • Accurate Information: You agree to provide accurate, complete, and up-to-date information during registration and maintain the accuracy of such information.
  • User Verification: Bajhi may (but is not required to) verify your identity, business, bank accounts, or other credentials at any time. Failure to provide information, or provision of false or misleading information, may result in account suspension or termination.
  • Account Types: You may register as an individual, company, team, or other legal entity. Organization accounts must be managed by an authorized representative.

2.3 Account Security and Responsibility

  • Account Credentials: You are responsible for maintaining the confidentiality and security of your account credentials, including passwords and any authentication methods.
  • Activity Responsibility: You are solely responsible and liable for all activities that occur under your account, including those by subusers and team members.
  • Unauthorized Use: You must promptly notify Bajhi of any unauthorized use of your account or security breach. We are not liable for loss or damage arising from your failure to comply with this section.

2.4 Prohibition on Multiple/Shared Accounts

  • You may not sell, rent, share, or transfer your Bajhi account to anyone else without our explicit written permission.
  • You may not register more than one account for yourself or entity except as expressly permitted (e.g. for business and personal use).

3. User Roles and Relationships

3.1 User Roles

  • Clients/Buyers: Users seeking to purchase, license, or commission digital products, websites, apps, AI agents, automations, or freelance development/services.
  • Freelancers/Sellers/Vendors/Shop Owners/Developers: Users offering products, services, website templates, plugins, automations, apps, AI agents, or support through the Bajhi marketplace.
  • Subusers/Team Members: Users or representatives added to business, agency, or organizational accounts to manage stores, projects, or websites.
  • Affiliates: Users participating in Bajhi’s affiliate program.
  • Administrators/Moderators: Designated Bajhi employees or representatives authorized to enforce policies, moderate disputes, and support Users.

3.2 Roles and Permissions

  • Account Owner: Responsible for all activity and users under the account, including subusers or delegated team members.
  • Subuser/Team Member Permissions: Subuser or team accounts may be granted specific permissions by the Account Owner, including ability to manage listings, access communications, or make purchases. You are responsible for permission management, and all subuser actions are attributed to the Account Owner.
  • Vendor/Freelancer Responsibilities: Vendors/Sellers/Freelancers must provide accurate listings, deliver services/products as described, comply with applicable law and intellectual property requirements, and resolve disputes in good faith.
  • Client Responsibilities: Clients are responsible for providing clear requirements, paying promptly for purchases/services, and communicating respectfully and in good faith with vendors.
  • No Employment/Agency Relationship: Bajhi is not a party to contracts between Freelancers and Clients. Use of Bajhi does not establish any employment, partnership, or joint venture between Bajhi and Users, or between Users themselves.

3.3 Relationship with Platform

  • Marketplace/Intermediary Role: Bajhi acts as an online service provider and intermediary platform, connecting Users for the purpose of commerce, collaboration, and content creation.
  • No Guarantee: Bajhi does not guarantee any particular outcome, revenue, work, or success for any User. All User interactions, contracts, and agreements outside these Platform Terms are solely between the respective parties.
  • Moderation Rights: Bajhi reserves the right to moderate, suspend, terminate, or restrict access, accounts, or content in accordance with these Terms and applicable law.

4. Platform Use, Access, and License

4.1 Permitted Use

  • Bajhi grants you a limited, non-exclusive, non-transferable, revocable right to access and use its Platform and Services in accordance with these Terms.
  • You may use Bajhi to buy and sell digital products/services, design and launch websites, use apps and automations, communicate with other users, participate in affiliate programs, and any other services expressly provided.

4.2 Prohibited Conduct

You agree NOT to:

  • Use the platform for any unlawful, illegal, fraudulent, or harmful purpose or to violate any national, state, or local law or regulation.
  • Infringe upon or violate intellectual property rights, publicity/privacy rights, or other rights belonging to Bajhi or any third party.
  • Upload, share, or distribute: viruses, malware, ransomware, pirated software, or other malicious content.
  • Use or launch automated systems (including bots, spiders, scraping tools) without explicit written permission.
  • Circumvent security measures, attempt unauthorized access, probe/vulnerabilities, or disrupt (or attempt to disrupt) Bajhi or its Services.
  • Impersonate any person/entity, or misrepresent your affiliation with any person/entity.
  • Post, transmit, or otherwise make available any false, misleading, defamatory, obscene, adult, hateful, violent, harassing, or otherwise objectionable content.
  • Violate platform usage limitations, including excessive bandwidth, storage, or API use.

4.3 License to Users

  • Subject to your compliance, Bajhi grants you access under these Terms for personal or legitimate business purposes only.
  • You may not duplicate, modify, publish, sell, sublicense, or exploit any part of Bajhi or its content except with explicit written permission, or as otherwise permitted through Bajhi’s provided functionality.
  • All rights not expressly granted to you are reserved by Bajhi.

4.4 User Feedback and Suggestions

  • If you provide feedback, suggestions, or ideas to Bajhi, you grant Bajhi a perpetual, irrevocable, royalty-free, worldwide license to use, adapt, and incorporate your feedback without compensation or acknowledgment.

5. Marketplace/Transactions

5.1 Operation of Marketplace

  • Bajhi provides a marketplace for freelancers/vendors to list digital goods (templates, plugins, apps), services, automations, and for clients to discover, purchase, and commission these offerings.
  • Users may post requests (job/project postings) or list products/services in accordance with platform categories and rules.

5.2 Listing, Bidding, Proposals, and Agreements

  • Listings: Sellers/vendors are responsible for ensuring product or service listings are accurate, legal, descriptive, and not misleading.
  • Proposals/Bidding: Clients may invite proposals or bids from freelancers/vendors for custom services or website builds. Sellers may respond with offers, proposals, or negotiations through agreed channels.
  • Agreement Formation: A binding contract is formed when a client accepts an order/proposal or makes payment, according to listing terms and any mutually agreed written communication. Bajhi is not a party to these contracts.

5.3 Payment Terms

  • Digital Goods & Templates: Payment is due upfront at checkout unless otherwise stated.
  • Services/Projects: May use milestones, escrow, or staged payments. Bajhi may facilitate secure payment holding until deliverables are accepted.
  • Automations/AI Agents/Apps: Payment terms as described per listing or subscription.
  • Subscriptions: Automatically renewed unless canceled in advance.
  • Refunds/Cancellations:
    • For digital goods, support, or downloadable items, all sales are generally final unless otherwise specified in the listing or platform policy.
    • For services, refunds may be granted if work is not delivered or in case of clear delivery disputes, per Bajhi’s internal dispute process.
    • Any refund or cancellation request must comply with the applicable product/service and platform policy.
  • Taxes: Buyers and sellers are responsible for their own applicable taxes. Bajhi may collect, withhold, or remit taxes as required by law.
  • Cross-Border Payments: Buyer is responsible for foreign currency conversion fees, taxes, or transfer charges unless the listing/service states otherwise.
  • Intermediary Role: Bajhi may serve as payment processor, escrow intermediary, or facilitator of transactions but does not guarantee payment/collection outside its payment tools.

5.4 Disputes, Holds, and Chargebacks

  • Bajhi may place a hold on payments subject to dispute, investigation, or suspected fraud.
  • Chargebacks, reversals, or fraudulent payment activity may result in account suspension or termination.

6. Product & Service Listings

6.1 Listing Accuracy and Legality

  • All digital product and service listings must be truthful, accurate, complete, and comply with applicable law and intellectual property standards.
  • Sellers must not list any item/service that is prohibited, illegal, infringing, misleading, or otherwise offensive.
  • Listings may not include adult, hate, violence, malware, pirated, or restricted content. Bajhi reserves the right to remove or moderate listings at its discretion.

6.2 Copyright & Intellectual Property

  • You may only upload, sell, or offer content which you have full rights to or proper licensing for.
  • If you believe your copyright or other rights are being violated on Bajhi, you may submit a claim (such as a DMCA notice) through our official notification process. Bajhi will investigate and may take down disputed content.
  • Sellers agree to indemnify Bajhi for any claim resulting from infringement of third-party rights through their listings or content.

6.3 Takedown Procedure (e.g. DMCA)

  • Upon receiving proper notice of claimed infringement, Bajhi reserves the right to suspend, unpublish, or remove affected content and inform the uploaders. Repeated or egregious violations may lead to account termination.

6.4 Prohibited Items & Services

  • You agree not to list or offer: illegal products/services, counterfeit goods, pirated software/code, harmful scripts, phishing, scam, adult content, discriminatory content, or items violating local or international law.

6.5 Listing Moderation

  • Bajhi may review, approve, moderate, or reject any product or service listing at its own discretion and without notice.
  • Listings that are incomplete, misleading, or violate policy may be removed with or without warning.

7. Website Builder and Hosting

7.1 Content Policy for Hosted Sites

  • Permitted Content: You may use Bajhi to publish websites built from templates or custom builds, provided all content on your hosted site complies with these Terms and all applicable laws and regulations.
  • Prohibited Content: You may not use Bajhi’s hosting or website services to disseminate:
    • Illegal or unlawful materials
    • Adult, obscene, or pornographic content (including child pornography, revenge porn, or similar content)
    • Hate speech, threats, harassment, or discrimination
    • Malware, ransomware, viruses, or malicious code
    • Content infringing on intellectual property or privacy rights
    • Fraudulent, misleading, or deceptive material
    • Phishing websites or sites designed to steal data
  • Content Monitoring: Bajhi reserves the right (but assumes no obligation) to review, moderate, remove, suspend, or disable access to any hosted content or site at any time and for any reason.

7.2 User Responsibility for Content/Site Management

  • You are fully responsible for all content published on your Bajhi-hosted websites, including text, media, downloads, links, and third-party scripts.
  • You must ensure your site complies with data privacy (e.g., GDPR), accessibility, and local or international regulations applicable to your content or audience.
  • You are responsible for site backups, security practices, and moderation of user-submitted content on your own site.

7.3 Service Availability

  • Uptime & Maintenance: Bajhi aims to provide high platform uptime but does not guarantee uninterrupted service. Scheduled maintenance, updates, or unforeseen outages may temporarily affect site accessibility.
  • Storage & Bandwidth Limits: Your site may be subject to fair usage, storage, and bandwidth policies as defined in your selected plan or by Bajhi. Bajhi may restrict or suspend access in cases of abuse or excessive consumption impacting overall service.

7.4 Data, Backups, and Liability

  • Bajhi may provide regular data backups of hosted sites for operational reliability. However, you are solely responsible for maintaining copies of your website content, and Bajhi is not liable for any loss or corruption of data.
  • Bajhi is not liable for any damages, lost revenue, business loss, or other losses resulting from downtime, data loss, or service interruptions.

8. E-commerce/Shop Features

8.1 Store Setup and Product Listing

  • You may set up an online store (shop) on Bajhi or on your Bajhi-hosted website.
  • You are solely responsible for the accuracy, legality, and completeness of all product or service listings, including descriptions, images, and pricing.
  • Listings must comply with all applicable local, national, international, and platform laws and guidelines.

8.2 Pricing, Payments, and Gateways

  • You may set your own prices for goods or services, subject to platform minimums or fee schedules.
  • All payments for store transactions must be processed via Bajhi-approved payment gateways. You may not solicit or accept off-platform payments for goods or services listed on Bajhi.
  • Transaction and/or payment processing fees may apply as described on the site.

8.3 Order Management, Fulfillment, and Shipping

  • You are responsible for all customer communication, order processing, and prompt fulfillment as described in your product/service terms.
  • If your offerings include physical goods, you are responsible for shipping, returns, and compliance with cross-border trade regulations.
  • For digital products, you must provide access and downloads per your listing terms upon confirmed payment.

8.4 Complaints and Returns

  • You must clearly communicate your refund, replacement, or return policy for each product or service.
  • If a dispute arises between you and your customer, you must work in good faith with both the customer and Bajhi to resolve the issue.

8.5 Store/Shop Policies

  • Bajhi reserves the right to moderate, suspend, or remove shops or shop offerings in violation of these policies or in response to complaints or disputes.

9. Freelancer/Service Marketplace Features

9.1 Project/Job Posting Guidelines

  • Clients may post projects, briefs, or requests for custom work, subject to moderation.
  • Project postings must be clear, accurate, non-misleading, and not solicit illegal, unethical, or prohibited activities.

9.2 Freelance Work Agreements

  • Bajhi encourages the use of written agreements or the acceptance of terms through platform communications for every project. Templates or suggested contract language may be provided but are not mandatory.
  • Neither party may circumvent the Bajhi platform (e.g., by moving payments off-platform to avoid fees).

9.3 Payment Milestones, Escrow, and Release

  • For freelance projects, Bajhi may provide an escrow feature, holding payments until defined deliverables or milestones are approved by the client.
  • Once the client marks the milestone or project as complete, funds will be released to the freelancer per platform rules.
  • If the client does not accept deliverables or raises a dispute, funds may be held until resolution (see Dispute Resolution).

9.4 Dispute Process

  • Bajhi provides an internal dispute process. If parties cannot resolve delivery or payment disputes, Bajhi staff may review evidence and determine an equitable outcome, subject to platform policy.

9.5 Ratings & Review System

  • Clients may leave public ratings and reviews for freelancers upon completion of a project/service, and vice versa.
  • False, fraudulent, retaliatory, or manipulative reviews are prohibited.

9.6 Service Delivery, Deadlines, and Late Work

  • Freelancers/services must deliver work to reasonable professional standards and meet any stated deadlines.
  • Late/non-delivery without proper communication may result in cancellation, refund, or platform penalties.

9.7 Non-Circumvention

  • Users agree not to bypass Bajhi by communicating, contracting, or accepting payments outside the platform for projects, services, or clients first contacted via Bajhi. Violation may result in permanent account suspension.

10. Digital Product Marketplace Features

10.1 Licensing Types

  • Regular License: Permits the buyer to use the product (template, app, plugin, agent, automation, etc.) for a single end project, either personal or commercial, according to the terms set in the product listing.
  • Extended License: Grants broader usage rights, such as use in multiple end projects or redistribution (where expressly allowed). Terms for an extended license will be specified on the product page.
  • Custom/Additional Licenses: Some products may have custom license options. Buyers and sellers are responsible for understanding and adhering to the licensing details provided in the listing.

10.2 Support Policy for Digital Goods

  • Included Support: Many digital products include limited support (e.g., installation help, minor bug fixes) for a period stated in the listing. Additional support or customization may be offered for a fee.
  • No Support Option: Some products may be sold “as-is” without support; this will be made clear in the listing.
  • Contact and Dispute: If you have issues with a digital product, contact the seller via Bajhi messaging first. If not resolved, you may initiate a dispute subject to Bajhi’s dispute process.

10.3 Re-downloads & Updates

  • Re-downloads: Products purchased through Bajhi may be re-downloaded as long as your account is active and the product remains available. Bajhi does not guarantee perpetual access unless stated.
  • Updates: Sellers may provide free or paid updates at their discretion. The scope and duration of updates will be described in the product listing.
  • Deprecation: Bajhi and sellers reserve the right to deprecate or discontinue products at any time. Notice may be provided where feasible.

11. Fees, Charges, and Payouts

11.1 Fee Schedules

  • Listing Fees: Bajhi may charge sellers a one-time or recurring fee for listing products/services, as described in the pricing or seller dashboard.
  • Transaction/Commission Fees: A platform fee is deducted from each sale, as disclosed on the Fees page or seller dashboard.
  • Subscription Fees: Certain features, services, or premium plans may require a monthly or annual subscription.
  • Payout Fees: Withdrawal of earnings may incur withdrawal or processing fees, depending on the payment method chosen.
  • Fee Changes: Bajhi reserves the right to modify its fee structure upon reasonable notice. Continued use after notice constitutes acceptance.

11.2 Payment, Currency & Timing

  • Accepted Methods: Sales and payouts are processed through approved payment gateways (e.g., PayPal, Stripe, bank transfer).
  • Currencies: Transactions are conducted in the platform’s default currency unless stated otherwise. Bajhi is not responsible for currency conversion fees or fluctuations.
  • Payout Timing: Seller payouts are subject to a holding period (to allow for chargebacks, refunds, or disputes), after which eligible funds may be withdrawn to your nominated payment method.
  • Minimum Payout: Withdrawals may be subject to a minimum threshold as specified on the platform.

11.3 Disputes, Hold-Backs, and Reserves

  • Platform Reserves: Bajhi may retain a portion of funds on hold for pending transactions, dispute resolution, or chargeback risk. Users will be notified of such actions.
  • Chargebacks/Refunds: If a transaction is reversed or refunded, Bajhi may recover such amounts from the seller, including via future earnings.

11.4 Taxes

  • Seller Responsibility: Sellers are responsible for declaring and paying any income, VAT, GST, or other taxes due based on their activity.
  • Withholding: Bajhi may withhold taxes as required by law and provide documentation/certification as necessary.

12. User Content, Reviews, and Community

12.1 User-Generated Content Policy

  • You may contribute content (e.g., templates, reviews, forum posts, documentation, support replies, comments, etc.) provided that such content does not:
    • Violate any law, regulation, or intellectual property right
    • Contain malware, adult content, hate speech, or misleading information
    • Include personal data of others without consent
  • You grant Bajhi a worldwide, non-exclusive, royalty-free license to use, publish, display, adapt, or remove your content for any platform-related or promotional purpose.

12.2 Moderation, Reporting, and Takedown

  • Bajhi reserves the right (but assumes no obligation) to moderate, edit, block, or remove content that violates these Terms, at its sole discretion.
  • Users can report inappropriate or infringing content. Bajhi will investigate and take appropriate action.

12.3 Review & Rating System

  • Users may post reviews and ratings on products, services, or freelancers/clients, provided feedback is honest and based on real transactions or interactions.
  • Manipulation of reviews (fake reviews, review swapping, retaliatory or incentivized reviews) is strictly prohibited.
  • Bajhi may monitor and remove reviews that violate policy or are found to be fraudulent.

12.4 Forums, Groups, and Messaging

  • Where Bajhi provides forums, user groups, chat, or direct messaging:
    • Users must abide by community guidelines and applicable laws.
    • No spam, harassment, illegal promotion, or commercial solicitation outside the scope of the platform.
    • Bajhi reserves the right to restrict or ban participation for violation of these standards.

13. Intellectual Property

13.1 User Content Ownership

  • Ownership: You retain all rights and ownership to your content (e.g., product listings, website content, designs, apps, automations, code, graphics, and written material) that you upload or create using Bajhi.
  • Seller Responsibility: Sellers agree that any content they list, license, or sell through Bajhi is either their original work or they have valid rights and/or licenses to do so. You are fully responsible for your uploaded content’s integrity and legality.
  • License to Bajhi: By uploading, listing, or posting content on Bajhi, you grant Bajhi a worldwide, royalty-free, non-exclusive license to use, host, publicly display, reproduce, promote, distribute, and modify your content for platform operation, marketing, curation (e.g., editor’s picks, featured listings), analytics, or improvement purposes.

13.2 Platform IP

  • Ownership: All platform technology, design, code, processes, user interface, branding, trademarks, and any content created or provided by Bajhi (excluding user-generated content) are and remain the intellectual property of Bajhi or its licensors.
  • Restrictions: Except for use as expressly permitted by these Terms, you may not copy, distribute, modify, reverse-engineer, create derivative works, or exploit any part of the Platform IP for resale or unauthorized use.

13.3 Copyright, Trademark, and DMCA Procedures

  • Copyright Infringement Claims: If you believe your intellectual property rights have been violated on Bajhi, please follow our Copyright/DMCA policy (with instructions available at [copyright or legal page link]).
    • Submit a valid written notification of alleged infringement specifying the content, your rights, and requested action.
    • Upon receipt, Bajhi will review and may suspend or remove the content pending investigation.
  • Counter-Notification: The uploader may submit a counter notice as afforded by law, and Bajhi will handle restoration or permanent takedown accordingly.
  • Repeat Infringer Policy: Bajhi reserves the right to suspend or terminate accounts with repeated or egregious IP violations.

13.4 Use of Marks and Promotion

  • You grant Bajhi the right (but not the obligation) to use your business name, logo, or site screenshots for internal records, support, customer showcases, promotional content, and marketplace curation unless you notify us otherwise in writing.

14. Privacy and Data

14.1 Reference to Privacy Policy

  • Your use of Bajhi is subject to our Privacy Policy, which explains how we collect, use, process, store, and share your personal and business data.
  • Consent: By using Bajhi, you consent to the collection, processing, and sharing of your information as described in the Privacy Policy.

14.2 Data Handling and Security

  • Bajhi adopts commercially reasonable measures to protect your data and prevent unauthorized access, disclosure, or misuse.
  • You are responsible for safeguarding your account credentials and maintaining the privacy of any content or personal information you share via your sites or communications.

14.3 Data Retention and Sharing

  • Bajhi retains your personal and business data as required to fulfill the purposes described in our Privacy Policy, to operate the platform, comply with legal obligations, resolve disputes, and enforce agreements.
  • We may share your data with third-party service providers (e.g., payment processors, analytics, infrastructure partners) as necessary for platform functionality, subject to strict data processing agreements.
  • Upon account closure, Bajhi may retain certain important data as required by law or for legitimate business needs. Data deletion options are covered in the Privacy Policy.

14.4 User Rights

  • You may access, update, or request deletion of your personal data via your account settings or by contacting Bajhi at the details in Section 20.
  • Your rights regarding data portability and objection to processing are outlined in the Privacy Policy and may depend on local data protection laws.

15. Platform Relationship and Disclaimers

15.1 Platform as Service Provider/Intermediary

  • Bajhi operates as an independent intermediary, providing a platform for users to transact, communicate, and publish content. Bajhi is not a party to contracts, agreements, or engagements between users (freelancers, vendors, clients, buyers).
  • Bajhi does not guarantee nor is responsible for the accuracy, quality, legality, or safety of user-generated content, products, or services offered via the platform.

15.2 No Guarantee of Outcome or Earnings

  • Bajhi makes no guarantee or representation regarding specific earnings, success, buyer or seller activity, availability of work, or business outcomes.

15.3 Disclaimer of Liability

  • To the extent permitted by law, Bajhi and its affiliates, directors, officers, employees, partners, and suppliers shall not be liable for any:

  • Platform and Services are provided “as is” and “as available.”

15.4 Suspension, Termination, and Enforcement

  • Bajhi reserves the right (at its sole discretion) to restrict, suspend, or terminate any account, product, or site for violations of these Terms, unlawful activity, fraudulent conduct, or at the instruction of legal authorities.
  • Bajhi may restrict or forfeit access to, and may delete, any data, websites, products, or account information associated with such actions.

15.5 Limitation of Responsibility

  • While Bajhi strives for secure payments, safe transactions, and user protection, you acknowledge all business, legal, and financial decisions are ultimately your responsibility.

16. Termination and Suspension

  • By Bajhi: We may, with or without notice, suspend, restrict, or terminate your account or access to parts/all of the platform (including your websites, shops, listings, or access to funds) in cases including but not limited to:
    • Breach or suspected breach of these Terms or other platform policies
    • Prohibited, fraudulent, or illegal activity
    • Intellectual property violations, repeat DMCA takedowns, or rightsholder complaints
    • Non-payment of fees, unresolved chargebacks, or payment abuses
    • Threats, abuse, harassment, or behavior endangering community safety
    • At our sole discretion for business, legal, security, or technical reasons
  • By User: You may close your account at any time via your dashboard or by written notice to support.

16.2 Data Deletion Policy

  • Upon termination, your account data, listings, and website/projects are subject to permanent deletion and removal after a reasonable retention period (except where retention is required for legal, financial, or tax reasons).
  • Some residual data such as transaction records, reviews, or records required for the legitimate business purpose or under law may be retained by Bajhi as detailed in the Privacy Policy.

16.3 Refund and Wallet Return Policy

  • Unused wallet funds may be refunded at Bajhi’s discretion after deducting any owed fees, refund/chargeback exposures, or penalties related to breaches of these Terms.
  • Eligibility for refunds on subscriptions, services, or digital goods follows the product-specific or platform-wide refund policies in effect at the time of termination.
  • Bajhi is not liable for any third-party or external account fees, and all such associated costs are the user’s responsibility.

17. Dispute Resolution

    • Users should first communicate directly through Bajhi’s messaging or order systems.

    • Bajhi staff will review, mediate, and may render a final decision (including payment reversal, refunds, or release of escrowed funds).

  • Bajhi assumes no liability for the actions or omissions of third-party providers, nor for any resulting consequences.
  • Disabling or removing an integration is your responsibility.

  • Bajhi may occasionally display links to third-party websites or resources. Such links are provided for your convenience, and Bajhi does not endorse, control, or take responsibility for their content or activities.
